Van Halen Files Lawsuit Against Nike

WWD reports on a cause of action for copyright infringement suit filed against Nike by the Van Halen rocker’s company, ELVH Inc.

“ELVH alleges that the design of certain Nike Dunk Low styles infringe on the copyright the company holds for the red-white-and-black-striped pattern Van Halen made famous on his “Frankenstein” guitar — and for which the musician has held the copyright since 2001.

Citing “irreparable harm and damage,” ELVH is asking for the impoundment and destruction of all the shoes in question, as well as all profits from the sale of the shoes and damages.

In a statement provided to FN by a brand spokesperson, Nike said it was aware of the lawsuit but did not believe it to have merit. “Based on the information provided to us, we have not infringed on any rights held by Mr. Van Halen,” it said. “Nike’s Dunk shoe design is not substantially similar to any of the Van Halen designs, and Nike has not referenced the ‘Van Halen’ name or image as part of any marketing campaign or promotional material associated with the shoe.”

Following in the footsteps of the infamous Back to the Future-inspired Hyperdunk, Nike is set to release this Hypermax NFW (No Flywire). The shoe once again comes in a Marty McFly inspired colorway with a grey base, speckled midsole, light blue highlights and generous pink accents. Instead of the standard flywire technology, the mid-section is constructed from a flexible satin material. Glow in the dark is implemented on the sole, while the swoosh is a white patent leather. New digs

This coming June 2009, Nike will be releasing a new pack of sneakers specially for the women’s market with bright colors and spray paint details. The pack which include (from left) a blue sapphire Vandal Low, tour yellow Court Force High, neo turquoise Court Force High and a mean green Air Digs. so i haven't been postin bcuz i've been thinkin about me life and it's f****d up lol i mean my dad was shot in the forehead, got 3 blood clots, and he chouldn't have his hand bcuz of a atv crash and he shouldn't be alive my mom was a stunt motocycle rider and she was goin down the highway at like 3:00 90 mph like anyway 19 year old did a wheelie hit a bump and went flyin she shouldn't be alive and me when i was born my dad had to make choice who would live me or my mom and my mom said choice me but he did then the doctor said i wouldn't last a year but look i'm 13 years old and you already know about my sister but my brother almost went to jail for something he didn't do and back to me well almost killed myself things got soo bad but i'm goood now thiz iz me peace
